  • Customer Agreement

    • Here are the terms you need to know before using our website and services. This agreement, also known as the Terms of Service (TOS), applies to everything provided by guvihost.com ("guvihost.com", "us", "our"). By choosing to use our services, you agree to follow these terms. You can always find the latest version of these terms on our website. It's important to read and understand these terms before you buy any services from guvihost.com.

    • The Terms of Service (TOS) apply to all services provided by guvihost.com to you during the entire Term or Renewal Term. Before signing up for any hosting plans or services mentioned on guvihost.com, all customers must agree to all terms and conditions stated. You agree to use only licensed and legal third-party software in connection with your use of our services. guvihost.com reserves the right to suspend or cancel a customer's access to any or all provided services at any time, or when guvihost.com determines that the account has been inappropriately used or otherwise.

    • Violation of any of our policies will result in immediate termination and no refund will be provided in any case.

  • 1. Content

    • guvihost.com retains the authority to decline service or server access to any individual. Our services must be utilised solely for lawful purposes. It is strictly prohibited to transmit, store, or display any information, data, or material that violates any applicable laws or regulations.

    • The following activities and content are strictly prohibited on guvihost.com:

    • Top sites, Ponzi or pyramid schemes, prime bank programmes, bank debentures/bank debenture trading programmes, cryptocurrency/Bitcoin miners, Forex, e-gold, proxy services, bots, spam bots, mail bombers, port scanners, IP scanners, mail harvesting scripts, brute force scripts, chat rooms, banner rotators, file dumps, using disk space as secondary storage, sales of illegal pharmaceuticals, drugs, explosives, anonymous or bulk SMS gateways, malware, warez, phishing materials, lotteries, gambling, illegal downloads, pirated software distributions, escrow services, high-yield investment programmes, adult thumbnail galleries/banner exchanges, and streaming or broadcasting of live copyrighted events. Additionally, websites promoting illegal activities or linking to other websites that promote illegal activities are strictly prohibited.

    • We strictly do not allow the hosting of BPO (Business Process Outsourcing) websites, operations, or related services on any of our servers. This includes but is not limited to call-center operations, data processing services, telemarketing platforms, lead-generation systems, customer support process tools, or any infrastructure used for BPO activities. Any account found engaging in such activities will be suspended or terminated without prior notice.

    • guvihost.com strictly prohibits website content that promotes or advocates human trafficking in any form, as determined at the sole discretion of guvihost.com. Additionally, websites promoting prostitution or escort services are also prohibited.

    • Any website found to host child pornography, link to child pornography or contain exploitative content will be suspended immediately without notice or warning.

    • Adult materials, encompassing pornography, erotic images, or any other lewd or obscene content, are strictly prohibited. The determination of what constitutes "adult material" is solely at the discretion of guvihost.com.

    • Uploading, embedding, or linking to websites that promote audio, video, or high-resolution images is not allowed.

    • Illegal material encompasses copyrighted works, commercial audio, video, or music files, as well as any content that violates regulations or is deemed misleading.

    • Various illicit activities, including but not limited to pirated software, ROMs, emulators, phreaking, hacking, password cracking, IP spoofing, and encryption related to these activities. This also encompasses websites providing links or instructional content related to such illicit materials.

    • Hosting any type of game on our servers is strictly prohibited. If any gaming-related content is found in your hosting account, your account will be terminated immediately unless you opt for a gaming server.

    • Hosting an IRC server that is part of or connected to another IRC network or server, or having a connection to an IRC network, is strictly prohibited. Servers or virtual hosting accounts found to be connecting to or part of these networks will be promptly removed from our network without prior notice. Reconnection to the network will only be allowed once all traces of the IRC server have been completely removed, and access to your server is granted for verification. Any server found guilty of a second violation will result in immediate termination of the account. guvihost.com reserves the right to designate any other content or literature as "prohibited" if it is deemed indecent, rude, hateful content, or otherwise unacceptable. For detailed information regarding prohibited content and activities, please refer to the General Acceptable Use Policy. By the DMCA (Digital Millennium Copyright Act), guvihost.com has established procedures for individuals who believe that a hosted site on our service is infringing their copyrights. All copyright complaints must be submitted to abuse@guvihost.com.

    • Servers and hosting plans must not be used for SIP, VoIP, proxy services, IRCTC access, data mining, crypto mining, blockchain wallet hosting, crypto exchanges, betting, phishing, spamming, malware distribution, hacking tools, DDoS services, copyright infringement (including pirated software, movies, or music), terrorism-related content, fake documents, scam websites or any activity that violates local, national or international laws.

  • 2. Abuse of Resources

    • At guvihost.com, any attempts to compromise or compromise network devices, including port scanning, IP range scanners, and vulnerability scanning, are strictly prohibited. Similarly, denial of service (DOS) attacks directed at guvihost.com or launched from our servers are strictly forbidden. Hosting illegal software, source code, or materials, such as hacking tutorials, viruses, and copyrighted content, is also prohibited. Any infringement or suspected infringement will be thoroughly investigated and may result in immediate service termination. This includes hosting defamatory or private information without consent, as well as any attempts to undermine server integrity. Excessive resource usage that impacts other sites may require account upgrades, and disrespectful behaviour towards guvihost.com staff may result in account removal without refund. While we strive for 99.95% uptime, we cannot guarantee it due to necessary maintenance activities.

  • 3. Policy on Unsolicited Commercial Email (SPAM)

    • guvihost.com strictly prohibits the use of our service for transmitting unsolicited commercial or bulk email (SPAM). Violation of this policy will result in severe penalties. Upon notification of a suspected violation, we will conduct a thorough investigation and may restrict access to our network to prevent further violations. If a violation is confirmed, we reserve the right to restrict, suspend, or terminate the offending hosting account at our sole discretion. Additionally, we may pursue civil remedies for associated investigation costs and notify law enforcement authorities if the violation is deemed criminal. Hosting websites or services that support spammers or cause our IP space to be listed in spam databases will result in immediate account suspension. Accounts will only be reinstated upon removal of offending material. Violations may result in warnings, immediate account termination, or permanent removal from our network without notice. We have a zero-tolerance policy for posting messages or ads violating newsgroup or mailing list rules. Additionally, hosting publicly accessible "open relay" SMTP or anonymous remailer services is strictly prohibited.

  • 4. Bandwidth Usage Policy

    • If a customer's account surpasses the allocated bandwidth limit, guvihost.com will notify the customer accordingly. If the customer opts not to purchase additional bandwidth or upgrade their account and continues to exceed the limit, the account will be temporarily suspended until appropriate measures are taken by the customer to prevent further overages or until the account is upgraded, whichever occurs first. The account will be reactivated in the subsequent month.

  • 5. VPS and Dedicated Server Management Guidelines

    • For optimal management and operation of VPS (Virtual Private Server) and Dedicated Server, we typically advise using a control panel. Customers with a plain server are required to configure DNS, user accounts, mail accounts, and other related configurations independently. Our support team will not be responsible for these tasks.

  • 6. Policy on Commercial Ad Email or Spam

    • Sending unsolicited commercial emails (SPAM) from our servers or using email addresses maintained by us is strictly prohibited and will result in immediate deactivation of your site with no refund. guvihost.com reserves the right to determine what constitutes a violation of this provision. To optimise server performance, we have established limits on the number of outgoing emails per domain per hour. These limits vary based on the hosting plan: shared and reseller customers are allowed up to 100 outgoing mails per hour per hosting account, VPS/cloud customers up to 500 outgoing mails per hour, and dedicated server customers up to 1000 emails per hour. However, we do not guarantee inbox email delivery with any of our hosting plans.

  • 7. Backup Policy

    • Your use of guvihost.com services is solely at your own risk. You must back up all your user content to ensure you can access and use it when necessary. guvihost.com does not guarantee the backup of any account or user content, and you accept the risk of losing any or all of your user content. guvihost.com cannot be held responsible for data loss under any circumstances. For clients who have subscribed to paid backup services with shared and reseller hosting plans, we take daily backups of website files, databases and emails with a retention period of 7 days. Please note that backups maintained by guvihost.com do not include media files or backups stored by the client. For clients using the cPanel Backup Manager tool, backups should be downloaded from the server and deleted. Every Sunday, all backup files are removed from the server without notification. It is not allowed to use hosting space to store backups.

  • 8. Domain Policies

    • Domain Registrations: Once a domain is registered, no refunds are applicable. Domain Infringement: You are prohibited from registering a domain name that resembles a trademarked domain or a domain associated with a brand providing similar goods or services. Attempting to register such a domain name may result in liability for trademark infringement. For example, domains like flipkartsale.in, bajajfinancecs.com, and adtyabrlafnanc.co.in are not allowed Domain Renewal: guvihost.com will send reminders for domain renewal one month before expiry. We are not responsible for any failure or delay in domain renewal. Once a domain is renewed, no refunds will be provided.

  • 9. Unlimited Hosting Policies

    • Unlimited Disk Space/Bandwidth/Website Plans: guvihost.com does not set limits on the amount of bandwidth, disk space, or websites you can use for personal or small business websites, as long as they comply with our Agreement. However, if your usage or content poses a risk to server stability, performance, or uptime, you may be required to upgrade to a VPS, or we may restrict your website's resource usage.

    • Limits on Abuse and Fair Usage: guvihost.com employs measures to prevent abuse of its hosting services. Our "Unlimited" hosting offering is not intended for single or few subscribers to negatively impact the experience of others. Our service is designed for small and medium-sized businesses and may not support the demands of large enterprises or non-typical applications better suited to VPS or dedicated servers. We make reasonable efforts to provide additional resources to subscribers consistent with our terms, but automated safeguards are in place to prevent websites from adversely impacting the system until we can evaluate their resource needs.

    • Unlimited Hosting Space and Database Size: guvihost.com does not set specific limits on disk space usage for websites, as long as it complies with our terms. However, our service is not intended for unlimited online storage, videos, images, audio, games, backups, or archiving of electronic files. Accounts with excessive database sizes may be requested to reduce their size to ensure proper performance, or the account may be disabled. Each database size should not exceed 1 GB.

    • Unlimited File Transfer: guvihost.com does not limit the amount of visitor traffic or content a subscriber can upload to their website in a given month, as long as it complies with our terms. However, we reserve the right to limit processor time, bandwidth, processes, or memory if necessary to prevent negative impacts on other subscribers.

    • Unacceptable Resource Usage: Certain activities are prohibited to prevent excessive use of system resources, including running cron entries with intervals of less than 15 minutes, MySQL queries longer than 30 seconds, and using 25% or more of our system resources for longer than 90 seconds at a time. Additionally, the size of each mailbox should not exceed 5 GB, and the combined mailbox size per domain should not exceed 50 GB. These policies apply to shared and reseller hosting accounts. Please refer to our unlimited hosting policy for more details.

  • 10. Permitted CPU and Disk Usage Policies

    • Shared Hosting Space Usage: At guvihost.com, the space on our shared hosting servers is intended solely for web files and hosting a user's website. It should not be used for media storage, storing electronic files, website backups, FTP hosting, or demo purposes. We reserve the right to inspect shared hosting accounts for excessive utilisation of disk space, CPU, and other resources that violate our Agreement or Acceptable Use Policy (AUP).
      Enforcement of Policies: We reserve the right to terminate access to our services and take down or erase user content for accounts found to violate these Terms and Conditions and other policies. Usage limits for dedicated and VPS hosting plans will vary based on the resources allocated to the plan you have purchased.

  • 11. Reseller Policies and Client Responsibilities

    • Reseller Hosting Exclusivity: guvihost.com prohibits the use of shared hosting accounts for reselling web hosting services to others. Reseller hosting plans must be utilised for such purposes.
      Client Compliance: Resellers must ensure that each of their clients adheres to our agreement.
      Client Support: Resellers are responsible for providing customer service, billing, and technical support to their clients. guvihost.com is not obligated to offer support to reseller users. Any assistance required for client issues must be reported by the reseller on behalf of the user.
      Content Responsibility: Resellers are entirely accountable for any content stored or transferred under their reseller account and the actions of their users. guvihost.com may hold resellers liable for any activity from their client's account that violates the law or our agreement.
      Indemnification: guvihost.com shall not be held liable for the acts or omissions of our resellers. Resellers agree to indemnify guvihost.com against any claims brought by any customer resulting from the actions or omissions of the reseller.
      Plan Review and Changes: guvihost.com retains the right to review our reseller plans as necessary. Any changes will be publicly posted or designated at a later date by the company.

  • 12. guvihost.com as Reseller or Sublicensor

    • Utilisation of Third-Party Services: guvihost.com may utilise certain third-party services, hardware, software, and equipment and act as a reseller or sublicensor.
      Exemption from Liability: guvihost.com is not responsible for any alterations to the Services that render any resold products outdated, including improvements or adjustments that affect service performance.
      Failure or Defects of Resold Services: Any failures or defects of resold services, whether sold, sub-licensed, or provided by guvihost.com, shall not be considered a breach of the company's obligations under this Agreement.
      Limitation of Rights: Your rights or claims regarding the possession, licensing, performance, or infringement of any resold product shall be limited to those rights granted by the manufacturer of such resold product.
      Qualified Use of Resold Products: You are permitted to use any resold product provided by guvihost.com solely in connection with your use of the Services as allowed under this Agreement.
      Prohibited Actions: You are prohibited from cloning, altering, reverse engineering, tampering with, or using any resold product except in connection with the services.

  • 13. Uptime Guarantee

    • Scheduled Maintenance Exclusions: Any service interruptions or downtime resulting from scheduled maintenance conducted by guvihost.com or our network providers will not be considered as part of the uptime guarantee.
      Exemption from Third-Party Service Failures: guvihost.com bears no responsibility for failures of third-party services.
      Limitation of Liability for Unforeseen Circumstances: guvihost.com will not be held liable for failures or delays in fulfilling its obligations if such occurrences are beyond its reasonable control. These circumstances may include acts of governmental bodies, war, insurrection, sabotage, embargo, natural disasters like fire or flood, labour disturbances, transportation interruptions, telecommunications or third-party service interruptions (including DNS propagation), failure of third-party software or hardware, or difficulties in obtaining necessary materials, supplies, or power required for providing the Services.
      The total and maximum liability of guvihost.com in any circumstances of whatsoever nature against any damages or claims of any kind will not exceed beyond the revenue generated during the preceding 1 (one) month.

  • 14. Account Security and Company Systems

    • At guvihost.com, you are accountable for ensuring that your account is not misused and that unauthorised access is prevented. Safeguarding your password and restricting access to your account is imperative, as any misuse or unauthorised access could lead to consequences for which you are responsible. Prohibited actions include attempting to obtain another user's password, circumventing authentication measures, or interfering with service to any user, host, or network. We may monitor our systems to ensure authorised usage and protection against unauthorized access, and we reserve the right to suspend any account found connecting to a third-party network without consent. Failure to address ongoing issues with your account may result in its termination, and we may migrate your account to another datacentre as necessary.

  • 15. Billing & Cancellation Policy

    • At guvihost.com, account setup is immediate upon confirmation of payment via credit card, debit card, net banking, or PayPal. Dedicated server setup may take 2 - 3 working days and may extend further depending on the stock availability.
      Our 30-day money-back guarantee applies only to first-time signups and excludes subsequent sign-ups or renewals. Refunds are not applicable to various services, including Domain Registrations, Dedicated Servers, Cloud Servers, cPanel, Plesk, Webuzo, SSL certificates, hardware firewalls, any other add-ons, third-party licenses or software and more, as specified. Pricing modifications by software license companies will immediately affect our clients. Refunds are available for Linux and Windows shared, reseller and Wordpress hosting, but not for suspended or terminated services. 7 Days Money Back is offered on Forex VPS, Managed and Self Managed Linux and Windows VPS Hosting. Additional charges, including taxes and setup fees, are non-refundable.
      A free domain name is applicable if you purchase the Giga or WP-Ultimate Plan for an annual or biennial billing cycle. The domain name will be offered free only for a year only. Thereafter, renewal charges will be applicable. Free domain is applicable to .com, .in and .co.in extensions only. Free domain offers are subject to conditions, including deductions from refund amounts upon cancellation.
      Cancellation requests can be made through the client area, with data backup advised before initiating the process. Depending on the chosen option, immediate or scheduled cancellation will determine access to services until the end of the prepaid term.

  • 16. Taxes, Late Payment or Non-payment

    • At guvihost.com, prices listed on the site exclude taxes, which will be added to the final invoice upon adding items to the cart. The inclusive amount, including taxes, is non-refundable. Unpaid invoices may lead to suspension or termination of your web hosting account, with access restored only after clearing outstanding dues. Failure to renew your hosting account by the due date will result in immediate suspension on the following day, followed by termination within 24 hours. For example, if the due date is 1st January, the account will be suspended on 2nd January and terminated on 3rd January. Terminated accounts will not have data restored and will be treated as new accounts. Failure to renew subscriptions on time may result in charges on the invoice, and new orders or packages will not be activated for customers with outstanding balances.

  • 17. Account Termination

    • If you decide to discontinue our services at any point during your subscription with guvihost.com, there are several scenarios that may result in account suspension and termination. If you request immediate termination, your hosting account will be suspended immediately and terminated within 24 hours. Upon expiration of your subscription, if you place a cancellation request, your account will be suspended at the end of the subscription period and terminated within 24 hours thereafter. Failure to renew your hosting account by the due date will result in immediate suspension on the following day, followed by termination within 24 hours. For example, if the due date is 1st January, the account will be suspended on 2nd January and terminated on 3rd January. Violation of our Terms of Service will lead to immediate account suspension and termination upon notification. In the event of potential fraud detected by our anti-fraud system, we will initiate a verification process, and failure to provide the requested information may result in immediate suspension and termination. In cases of disputes or chargebacks, we will suspend the account initially and provide a 7-day timeframe to resolve the issue, with termination occurring if the matter remains unresolved. It is advisable to maintain a backup copy of your hosting account to prevent data loss upon termination, as all files will be deleted from the server, and guvihost.com shall not be liable for any loss of data.

  • 18. Indemnification

    • Under the terms of guvihost.com, customers agree to indemnify, protect, and hold guvihost.com harmless from any liabilities, losses, expenses, claims, and reasonable attorney's fees incurred by guvihost.com, its agents, officers, employees, and administration. This indemnification applies to any services provided, performed, or agreed to be performed, as well as any products sold by customers, agents, employees, or assigns of guvihost.com. Customers also agree to defend and indemnify guvihost.com against liabilities arising from: any injury to a person or property caused by products sold or distributed in connection with guvihost.com's services, the loss of any electronic files provided by the customer or their customers; and copyright violations or defective products sold to customers through guvihost.com's services.

  • 19. 404 Error Page

    • For certain services offered by guvihost.com, if you haven't configured a custom 404 error page, our default page will be displayed when visitors attempt to access a URL with no content. By not creating a custom 404 page, you authorise guvihost.com to display our default 404 error page, which may include advertisements and information about our services. guvihost.com reserves the right to retain and collect all revenue generated from these advertisements.

  • 20. Change in the Cost of the plan

    • Price adjustments may occur periodically for our services at guvihost.com, influenced by updates in pricing from our vendors. As authorised partners of various license providers and domain registrars, any alterations in their pricing structure may necessitate adjustments to our service prices to align with our costs. It is advisable for customers to regularly review their billing information to stay informed about any potential changes in pricing and avoid unexpected surprises.

  • 21. Identity Verification

    • For first-time signups, you may be required to provide a copy of your Aadhaar card or complete Aadhaar-based OTP verification. If these steps are not completed, your order will be cancelled and you will receive a refund.

  • 22. Third-Party Beneficiaries

    • With regard to guvihost.com, unless expressly stated otherwise in this Agreement, it is understood that no rights are conferred upon any individual apart from the Parties involved herein, along with their respective successors and authorised assignments. However, it is acknowledged by the customer that every provider of a third-party good or service as described in the contract's definition of a third-party beneficiary is considered the designated third-party beneficiary of the obligations outlined in this Agreement. This designation arises because the terms and conditions exclusively apply to their goods or services, granting them the explicit right to enforce these terms and conditions.

  • 23. Software License Responsibility Clause

    • The client acknowledges and agrees that guvihost.com is not liable for any software licenses, including operating system, control panel, SQL licenses, and other software licenses that are purchased and installed by the client on the server by themselves. The client is solely responsible for ensuring that all software installed on the server is properly licensed and agrees to indemnify and hold the vendor harmless from any claims arising from the installation or use of unlicensed software.

  • 24. Abusive or Inappropriate Conduct

    • The Client agrees to engage in professional and courteous communication with the personnel and representatives of guvihost.com at all times. guvihost.com reserves the right at its sole discretion to determine whether any conduct, including but not limited to the use of abusive, offensive, harassing, defamatory, threatening, or otherwise inappropriate language or behaviour, whether verbal, written, or via electronic communication, constitutes a violation of this provision. Upon such determination, guvihost.com may take any action it deems appropriate, including but not limited to the immediate suspension or termination of the Client’s account and related services without prior notice and without any liability. If you are abusive towards any member of our staff we have full right to terminate your account with us without any refund.

  • 25. Change of TOS

    • Concerning guvihost.com, it is within our discretion to amend these Terms of Service (TOS) at any time, and such changes will take immediate effect. Suppose a change is necessitated by law or involves the addition of new services or functionalities that neither diminish your rights nor heighten your responsibilities. In that case, we reserve the right to make these modifications without prior notice to you. However, no clarification or explanation provided by either party will hold the authority to alter the provisions outlined in these TOS.

  • 26. Dispute Resolution – Jurisdiction

    • All disputes arising out of or in relation to the present agreement shall be subject to the exclusive jurisdiction of Nashik, Maharashtra, India.
      Every dispute shall be resolved mutually between the parties, failing which the same shall be referred to a sole arbitrator appointed by guvihost.com.

  • 27. Data Backup and Recovery

    • guvihost.com shall not be responsible for maintaining, storing or recovering any data hosted on Self Managed or Managed VPS, Cloud Server, GPU Server or Dedicated Servers. In the event of operating system reinstallation, hardware failure, corruption or any other circumstance resulting in data loss, guvihost.com shall bear no liability for such loss or the inability to retrieve data. Clients are solely responsible for maintaining their own backups unless they have expressly subscribed to a paid backup add-on service. In such cases, the Support Team shall provide reasonable assistance in restoring data limited to the content available through the subscribed backup service.

Service Level
Agreement

Our Service Level Agreement (SLA) defines the uptime and performance standards we commit to. Please review it to know the guarantees and remedies available to you.

  • 1. Scope and Definition

    • Monthly Service Fee: The Monthly Service Fee encompasses the entirety of expenses incurred for the Services within a single billing month. In cases where payment is made in advance as a lump sum, the Monthly Service Fee is determined by dividing the lump sum payment by the number of months covered by said payment.

    • Monthly Uptime Percentage: A percentage reflecting service availability, calculated as:

      Monthly Uptime Percentage = 100% * (total operational minutes in a calendar month - downtime) / Total operating minutes in a calendar month

    • Downtime: The total number of monthly minutes when your Server loses external connectivity or functionality.

    • Exclusions: Situations where service unavailability, suspension, or termination are due to the following reasons:

      • Events beyond our reasonable control like earthquakes, submarine cable outages, telecommunication system failures, riots, natural disasters, etc.

      • Events caused by your actions or inactions while using the Service.

      • Events caused by your equipment, software, or technology (or that of a third party outside our control).

      • Your failure to comply with mandatory Service configurations.

      • Unauthorized or unlawful use of the Service, or violations of guvihost.com Terms and Conditions.

      • Unpaid charges owed to us.

      • Significant incidents or breakdowns of relevant internet service providers (ISPs).

      • Scheduled downtime.

    • Scheduled Downtime: Periods when the network, hardware, or service undergoes maintenance or upgrades. We will make reasonable efforts to notify you beforehand.

    • Service Guarantee: The minimum uptime percentage we strive to achieve (defined in Section 2).

    • Service Credit: A portion of your Monthly Service Fee is credited to you for valid downtime claims submitted through our service credit claim process (Section 3).

  • 2. Service Level Agreement

    • We are committed to exerting commercially reasonable efforts to achieve a Monthly Uptime Percentage of no less than 99.95% every calendar month concerning your utilization of the Service (referred to as the "Service Guarantee"). Should we fail to meet this Service Guarantee, subject to the terms and conditions outlined in this SLA, you reserve the right to claim a Service Credit rebate as detailed in Section 3. It's important to note that the Service Guarantee does not extend to Exclusions as specified.

    • Hardware Service Level Agreement (SLA): We promise that if there's a hardware issue with your server, we'll replace it within eight (8) hours of finding the problem. The countdown starts when you tell us about the issue, and we confirm it's because of faulty hardware.
